Selling an Inherited or Probate House in Farmington

If a house came to you by will, trust or probate, we sell it in the sequence the court and the documents call for. First we photograph its condition. Then we walk you through each step and give every heir and the attorney the same record to work from.

How an estate's house gets sold

Before an inherited house can be sold, someone needs legal power to sign for it. In California, that is usually a personal representative named by the probate court who holds Letters Testamentary or Letters of Administration. When the house sat in a living trust, the successor trustee signs instead. Our first task is figuring out which route fits, since it decides the timeline, the required notices and whether a judge has to approve the sale.

Next we take on the sale itself: setting a price from recent comparable sales, marketing the house, negotiating and keeping escrow on track. Your probate attorney stays in charge of the legal work, and we give no legal or tax advice.

For each estate, we record the house's condition at the first visit and at every stage that follows. Out-of-town heirs get the very report the executor gets. Working from one shared record prevents most of the disputes that hold these sales up.

What our help with an estate sale includes

  1. 01

Authority check before anything is signed

We review the letters or trust documents with you and your attorney so the right person signs the purchase agreement. A contract signed by someone without authority can fall apart in escrow.

  2. 02

    Room-by-room condition report

On the first walk-through we photograph the roof, attic, electrical panel, water heater, crawlspace and every room. Older houses often still have galvanized supply lines or ungrounded two-prong outlets. We note those early so a buyer's inspector finds nothing the estate didn't already know about.

  3. 03

    Contents and cleanout sequence

Furniture and personal belongings usually have to be dealt with before the property goes to market. We give you an order of work and document each room once it is cleared, so heirs can confirm what was removed.

  4. 04

    Pricing the estate can defend

We prepare a comparable-sales analysis and show how it lines up with the probate referee's appraisal. In court-supervised sales, the price relative to that appraisal can matter, so we put the numbers in writing.

  5. 05

Contract terms that fit a probate sale

Estate sales use different language than a standard sale. That includes a court confirmation clause where one applies and the narrower disclosure duties that often cover personal representatives.

  6. 06

One running record for every heir

Offers, counteroffers, inspection findings and repair requests go into one summary with pictures attached. Everyone reads the same thing at the same time.

Signs it is time to get help with the inherited property

  • The heirs disagree on keep or sell

One sibling wants to rent it out and another wants to sell. A written valuation and a record of the real condition give everyone the same facts to work from.

  • Carrying costs keep landing on one person

Property taxes, insurance, utilities and yard care don't stop after a death. If one heir is paying alone, a clear sale plan helps settle reimbursement at closing.

  • The house has been sitting empty

An unoccupied house through a hot summer tends to collect problems. Common ones are dead landscaping, rodents in the attic and a slow supply-line leak nobody sees for weeks. Some insurers also limit coverage on property left unoccupied.

  • Letters were issued but nothing has moved

Once the court appoints a representative, the estate's work is underway. Getting the biggest asset priced and prepared early keeps the probate from stalling.

  • You live far from Farmington

Executors out of state can run the sale by phone and video. Our condition reports stand in for the drive-by you can't make.

How an inherited house sale moves from first call to closing

  1. 1

    Phone, video or office consult

We talk through how title is held, whether there is a will or trust, and who has been appointed. You can meet us at our office or stay on the phone.

  2. 2

    Walk-through and condition record

We visit the property and photograph its condition room by room and system by system. Then we send you the full set with notes on what we found and why it matters to a buyer.

  3. 3

    Pricing and court requirements

We price against recent comparable sales and the appraisal. Then we confirm with your attorney whether the sale can go ahead with full authority under the Independent Administration of Estates Act and a Notice of Proposed Action to heirs, or needs a court confirmation hearing where other bidders can overbid.

  4. 4

    Marketing, offers and escrow

We market the property and present every offer in writing. Inspection items are documented with before-and-after pictures as they are resolved. Escrow closes once the required notices or court order are in place.

What affects the cost and what the estate nets

Our fee is set out in a written agreement before any work starts, and we go through it line by line. What the estate actually keeps depends on more than our fee. We don't quote figures until we have seen the property and the paperwork.

Condition at the time of sale
An aging roof, original wiring or a tired water heater all show up in buyer inspections. The condition record lets you decide early whether to sell as-is or handle a few repairs. We lay out both options so you can compare.
Court confirmation or not
A sale that needs a confirmation hearing takes longer and can draw overbids, which affects both timing and price. Sales under full independent authority usually move more like a standard sale.
Carrying and cleanout costs
Every month the house sits, taxes, insurance and utilities come out of the estate. Contents removal and cleaning are separate costs we help you plan around.
Loans and liens on title
A reverse mortgage, unpaid property taxes or old liens are paid off from the proceeds at closing. Reverse mortgage lenders typically set a deadline after the borrower's death, so we find out early.

Questions about selling an inherited or probate house

Can we sell the house before probate is finished?

Usually, yes. Once a personal representative has letters with authority to sell, the house can be sold while probate is still open. The sale is often how the estate pays its debts. Paying out the proceeds to heirs happens later, on the court's schedule.

The house was in a living trust. Does it still go through probate?

Usually not. The successor trustee can sell under the trust's terms without court supervision. The trustee still owes notice and accounting to the beneficiaries, so we confirm the details with your attorney before we start.

Do we have to fix anything before selling?

No. Many estates sell as-is. Our condition report lets buyers see and price defects up front instead of finding them in escrow. If a small repair is likely to pay for itself, we'll show you which one and why, and the decision stays with you.

Several heirs live in different states. How do we keep everyone informed?

Everyone gets the same condition record and written offer summaries, and we can hold video calls at key decision points. Only the personal representative or trustee signs, but nobody has to rely on secondhand updates.

What happens to the property tax base if one of us keeps the house?

California changed the parent-to-child rules under Proposition 19, and keeping the old tax base now generally depends on the heir living there. Your attorney or tax advisor should answer that part. We can give you the current market value so you can weigh keeping against selling.
